These include written representations, hearings and public inquiries. I act either on behalf of an appellant or a local planning authority, including the instruction of counsel by way of direct access.
This may be in connection with a planning appeal or a local plan examination. I am also regularly called upon to attend court concerning planning-related civil matters.
As a project moves through the planning process I will often instruct a number of people in complementary professions on behalf of my client, directing them as a team. These other professionals typically include highways consultants, architects, landscape architects and ecologists.
Third Party Representation
This usually involves representing a local resident or residents’ group who are opposing a scheme which is passing through the planning process. I will then make a presentation on their behalf at planning committee.
If someone has been served with an enforcement notice then I can represent them, guiding them through the subsequent appeal process. I am also able to work with clients to prepare their response to a planning contravention notice. If this request for information is dealt with professionally – and as early as possible – then the matter can often be successfully resolved before an enforcement notice is served.
I can advise on the implications of a policy or proposed allocation as a local plan emerges. This may well include appearing at a formal examination of the plan.
Applications and Appraisals
I often advise on the likely success of a proposed development or change of use. If the prospects are reasonable then I will go on to prepare and submit an application, taking it through the development control process. Applications can include express consent for planning, advertisements and listed buildings, or prior approval and certificates of lawfulness.
