My role: Expert witness at a public inquiry for the council against a residential scheme by Redrow Housing on a parcel of land that had been used for many years by the community as a leisure space.
The case: The planning committee had refused consent against the officer's recommendation for approval. I didn’t agree with the officer’s decision and made the case against it in support of the council. A difficulty lay in the fact that the council had not designated the land as an open or public space, opening the way for the developer’s application.
The outcome: Ultimately the appeal was upheld but, as a result of my involvement, the appellant was obliged to make a significant financial contribution to the erection and long-term maintenance of play equipment for the benefit of the local community.
